ACCIDENTS:
Q: What should I do to preserve
my rights if I am involved in an automobile accident?
A: If you are involved in an automobile
accident, you can better preserve your rights and/or claims
if you follow the following instructions:
i. Contact an attorney.
Do not make any statements about the accident until you have
contacted a lawyer. No one has the right to force you to give
an opinion as to the cause of the accident, be it at the police
station or elsewhere. You have the right to consult an attorney
before making a statement about the accident to anyone.
ii. Write down the Time,
Date and Location of the accident.
iii. Call an ambulance
(moving an injured person may aggravate the injury).
iv. Call the police (or
if the condition permits, proceed to a police station to make
an accident report)
v. Write down the name,
address, and phone number of everyone in your car.
vi. Make an effort to obtain
the names, addresses, and telephone numbers of all persons
who witnessed (saw) the accident.
vii. Write down the other
driver's name, address, phone number, driver's license number,
license plate number, insurance company name, and insurance
policy number.
viii. Again, if you are
in anyway injured or have any doubt at all about your condition
or that of the passengers in your vehicle, seek prompt medical
attention at the emergency section of an hospital that same
day, and make appointment for follow up visit(s) with your
doctor on as needed basis, and ask your passengers to do likewise.
ix. Immediately notify
your automobile insurance company that you have been involved
in an accident, however, do not give a statement about the
accident without first contacting a lawyer.
x. Take photographs of
any injury sustained and the damages to your vehicle.
xi. Save all forms of evidence
regarding the accident, do not throw anything away or change
its condition. |
